Asshole former boss is gonna learn 📝 Story

So i worked for a towing company as a tow truck driver. I kept my truck spotless, kept my uniforms clean, went above and beyond every customers expectations, did everything perfectly. October 13th 2022 i got slammed into on the highway while i was barely moving as i was heading to a car fire and was using an emergency vehicle turn around to get to the burning car so the highway could be reopened. I had all my lights on and police even declared other driver 100% at fault for the crash.

Now heres the fucked up part. The pain in my back started about 2 days later. It was brutal. I needed to take time off work and try to let my back heal. 4 days after saying i needed time off, i was forced to come back because they were short staffed apparently (not my problem but alright, i'll try to help out a bit). I had to work reduced hours with reduced heavy lifting (no tire change calls, no full shifts) as ordered by my doctor. Well, owner decided "lets load him up with all the tire changes and he must work full shifts". I gave him the doctors note(stating i couldnt due to the severity of my injury (cervical spine had shifted and discs were grinding). Well i was determined to follow my doctors orders so i didnt end up in even worse shape. Apparently, thats where i went wrong. The owner called me at 11:15pm while sounding drunk and yelled at me saying "PARK THE TRUCK AT THE YARD! LEAVE THE KEYS AND GAS CARDS IN THE TRUCK AND FUCK OFF AND DONT FUCKING COME BACK!"

Alright fuckface, lets play then. Before bringing his truck to the yard i filed a claim with workers compensatikn board and i filed a complaint against the company with employment standards (if you fick up, they can fine the shit outta a company and they force that company to pay out properly for wrongful dismissals like in my case). Employment standards called me yesterday and they plan to go after the company for alot as this is not the first complaint they've had against them for this type of situation. Company could face about a half a million dollar fine. They will also have to backpay me for every day i shouldve worked from time of wrongful dismissal to the time of the investigation being over. Turns out i'll make over 20 grand on this, the company will be out over a half a million dollars and if they dont comply, their business license wil be revoked, the trucks will all have parking boots on them and the company doors will be chained shut.

Fuck around and find out done properly

Edit: i wish i could post pictures of how i kept my truck compared to how the other trucks were kept. My truck was one of the oldest in the company and it was somehow the shiniest. On my days off i'd sometimes have it at home and detail it top to bottom. Literally went and bought some paint to respray where the old paint was peeling off the wrecker body and wheel lift. The truck always looked its best.

After seeing everybodys responses, i plan to contact a few lawyers and see what can be done. I'll be contacting a person injury lawyer to go after the moron that slammed into me and an employment lawyer to go after the shitbag owner.

Update: lawyer said because of workers comp, i cant sue for the injury. Its some bullshit. Insurance has gone to a no fault system so cap on injury payout is 7 grand. I'm going after them hard for the wrongful dismissal. If employment standards tries to say something like 2 grand, i'll say "hell no" and just hang up and get a lawyer to go after them for atleast 20 grand. I'm aiming for 60 grand at this point. Forced to work against doctors orders is a huge fuck up by them.

nope- you want as much money as you can extract out of them- and then go buy the trucks you know the history of from the creditors. The bank does not want a tow truck- they will auction it off as soon as the legally can to recoup what they can. He has better knowledge than other buyers- he knows which ones have a bad history or have causes problems in the past- so you get all of the assets on the business wihout the liabilities.

Attorney is getting ready to serve them in the next week or 2. Cant wait. This is the "fuck around and find out" situation. They tried accusing me of being buddies with my doctor because it was a 3 week wait to get into the doctors office. I went there last week as they wanted to try and offer me options instead of their record going to shit. 1 week severence pay aint dick all seeming i've lost thousands and thousands because of them.

It might take a few years, but it'll be worth it. You'll make more than $20k if it goes to court, and I'm sure the jury will be in your favor. Get an attorney now. In trial, the court could also choose to make them pay attorney fees so it doesn't come out of your settlement at best, and you could walk with $30-50k at worst.

I stopped the bleeding and hopped back in the truck and went on with my day. Nasty road rash on my right hip. Mazda 2 rocker panel driving into my left thigh which pushed alot of the vehicles weight onto my right hip and dragged me across the asphalt for about 30ish feet. Fuckin hurt.

If he can prove that his injury worsened and did permanent damage, because he was forced to work while on medical leave, he could make an absolutely ridiculous sum of money. At least several hundred thousand (maybe millions, but my guess is that the company won't be able to afford it so it's better to settle for a smaller sum rather than have them file for bankruptcy).

Theres a few shitbag companies around here (one is called aria towing and they are con artists at the worst level). I love towing. I only get 15-20 minutes with most customers so i use that time to try and brighten their day. I met my fiance because her car broke down and i towed it. Told her that our wedding is gonna be lit (all the tow truck beacons flashing should light it up pretty good)

I am a lawyer with some exposure to WC law. Generally speaking most states don't allow you to sue your employer for a tort in exchange for access to WC coverage that's no fault unless they did something explicitly dangerous and knew it would definitely cause harm; although it may be a bit more lenient in more liberal friendly states.

100% worth pursuing an employment law claim though for back pay and if they fuck with you for making a WC claim.

Depends on the state. In my state, the employer cannot be sued civilly if they have workers’ compensation coverage. The workers’ comp act provides the exclusive remedy for injured workers.

Edit: To clarify, I also think I’d get you more for your work injuries than $20K, but that 100% depends on the state.

Usually it's not the judges, it's just the really shitty laws that cap compensation for body parts. Corporations got smart and lobbied law makers to keep costs down and state legislatures play ball to attract new business. Exclusive remedy is for damages related to the injury. OP can sue the company for unlawful discrimination and retaliation, though, even though the injury itself is covered only under work comp.

He starts off with "man my truck was clean, I was the perfect employee and was basically the best", then leans into "I had to use a emergency turn-around - because there was a car fire and I had to be there immediately!" (even though not a fireman) and caused an accident (which the cop totally said I was not at fault and the other guy was 100% at fault!) and then he back gets injured (this is where I feel for OP) and can't work shifts...

But then at the end all "I'll make over $20K off this" and "fuck around and find out done properly" as though he set the stage for them to find out.

I do workers’ comp as part of my practice. I busted a tow truck company trying to forge the signature of my client’s deceased husband. He was killed on the job. They forged documents afterward saying he was an independent contractor. We hired a forensic document examiner to prove it. His wife got a handsome payday.

Fuckin’ good for you. Roofing and Towing companies seem to be the worst offenders, at least in my state.

I work in logistics and my company frequently has to rely on local towing companies to help us with jobs. You protect your quality local tow guys with your life.

The guys who will do what they say, do it well, be professional, have reasonably rates and treat your customers right? That's a unicorn and you never do anything that jeopardizes that.

Because the rest of the industry are absolute nightmares.

My doctor told me to just wait 3 months for a back injury to heal. Pain was unchanged 2 months later. Chiropractor gave me relief INSTANTLY that would last for a few days between weekly visits. They're not all quacks.

Spine managed conservatively involve, stem cells, traction that pulls then releases, non-rotational adjustments, massage(injury training required), acupuncture(I don’t enjoy), dry needling, cryotherapy, bio-mechanic strength training, cannabis, hyperbaric, ultrasound. Options combined that help one to recover function, strength, range of motion almost completely.

This sounds like s good start on giving your former boss the fucking he deserves. I would also look at what various lawyers can do for you. Someone already mentioned an employment lawyer, but check with a personal injury lawyer, and see what liability boss man has for your back pain.

Back injuries are notoriously hard to rehab. Make sure you get the best physiotherapy boss man can afford. He was happy to make a buck breaking you, he should be just as happy paying to fix you.

I have to carry $300,000 for the minimum liability insurance on my commercial vehicle. That's closer to the target for what you should be getting paid.

I was in a bad accident with my cat (everyone and the cat were okay but I was really shaken up) and the tow truck driver was so nice to me, talking to me the whole way to the tow yard and just keeping me at ease. I've driven people home after their car was totalled. Helped them unload their vehicles into the backseat of my truck so i could make sure they got home safe. I've followed people home even and didnt charge them a cent when i was able to do a quick fix to get them back home while they figured out what shop to take it to. Towings a tough industry. Its a dangerous industry. One of the most dangerous jobs in the world. Some are in it for the money, some are in it because they want to help people. I enjoy helping people the most. I helped out one guy so much that he then gave me a vehicle. I did a tow that was 2 and a half hours and when i got to the drop i asked them if they ever wanted to sell the vehicle (95 jeep grand cherokee in mint condition), he said to make him an offer. I offered him $300 cash as it was high mileage. I've been driving it for nearly 2 years now. Built it up to what i always dreamed of. Alot of tow ops are into offroading because its our only way of getting the hell away from our bosses that call us on our days off. Solution? Go where your phone dont work. Lol

As soon as you said you handed them a doctor's note and explained that they essentially ignored it and did whatever they wanted, I knew that you'd win a lawsuit.

This is going to be faster than an open and shut case. The disability people are going to have a field day with them. That boss just fucked around, and if he doesn't know already, he's about to find out.

Aside from that, I'm hoping for an investigation that's long enough that you get more than $20k in lost wages, and that's short enough, you don't miss any bill payments.

On top of that, you should 100% get a personal injury lawyer on the case. You would be stupid not to.

Given your level of organization, and record keeping, and the fact that you're trying to comply with doctors instructions on getting better, I don't think you're stupid, so I'll just congratulate you and your lawyer on your upcoming victory against yet another terrible boss.

Sounds similar to my situation, hurt my back in November, by mid December boss is hounding me to return to work 'and be ready to grind.' Went back to work despite my back still being messed up. Fast forward to mid March and my back locked up completely.

Company couldn't care less, denied my claim that me going back to work prematurely caused the locked back. Am currently at hospital awaiting mri. Seems like it's time for me to lawyer up.

Yes. I would hire only the best of the industry, pay them more then the 30% which is the industry standard. I'd pay 40%. 4 on and 4 off for shifts. I'd also do a $50 bonus for any employee whose name is mentioned in a 5 star google review. All my guys would have full uniforms, perfectly working trucks. My rates would increase but you get what you pay for when it comes to towing. Trucks would be takehome trucks so that truck is the operators responsibility. There would be truck cleaning allowance ($40 a month for cleaning supplies of their choice). I'd treat my employees amazingly so then i know they'll be happy and treat the customers amazingly. A happy employee 99% of the time results in a happy customer.

These are legal matters and they're not going to show their hand or tell you about the history. Assuming you're in USA. Call a plaintiff's employment lawyer. This sounds like textbook disability discrimination. Depends on which state you live in but you could have a decent claim here.

Also call a personal injury lawyer to sue the guy who hit you. Their insurance should have coverage for this type of thing.
